The 11-party alliance candidate and Convener of the National Citizen Party (NCP) Nahid Islam has filed an appeal with the Appellate Division challenging a High Court order that dismissed his writ petition seeking the cancellation of the nomination of BNP candidate MA Quayum in the Dhaka-11 constituency.

Nahid moved the Appellate Division on Saturday, alleging dual citizenship and concealment of information by Quayum.

His lawyer, Zahirul Islam Musa, confirmed the development and said the matter may be heard by the chamber judge on Sunday (8 Feb).

Earlier on 3 February, the HC summarily dismissed Nahid’s writ petition challenging the legality of Quayum’s candidacy.

The order was delivered by a bench comprising Justice Fahmida Kader and Justice Md Asif Hasan.

During the HC hearing, the writ petition was argued by lawyers Mohammad Hossain Lipu and Zahirul Islam Musa, while Quayum was represented by Ahsanul Karim, Ruhul Quddus Kajol, Mahbubur Rahman Khan and Kazi Akhtar Hossain.

Nahid had filed the writ petition on 2 February, seeking the suspension of Quayum’s candidacy in Dhaka-11 on grounds of alleged dual citizenship and suppression of information.

The chief election commissioner and other relevant authorities were named as respondents in the petition.

Earlier, the Election Commission had declared the nomination papers of both Nahid and BNP candidate Quayum valid for the Dhaka-11 seat ahead of the upcoming National Parliamentary Election.
